The Role of Comprehensive Employment Contracts in Ensuring Compliance
(some words of advice from HR Dynamics that we think should be shared)
Employment contracts are foundational documents that define the relationship between employers and employees. Well-structured contracts protect both parties and ensure adherence to legal obligations.
Essential clauses are:
• Position and Duties: Clearly outline the role and responsibilities of the employee.
• Start Date: Also very important! If it is a reissued contract, make sure that you include their original start date for LSL accruals
• Status: - Part Time, Full Time, Casual?
• Award & Classification: Don’t forget this! We see a lot of contracts where this is missed which is one of the most, if not the most, important clause!
• Remuneration and Benefits: Specify how the remuneration is made up (i.e wages with overtime and penalties / salary or flat rates and how they are made up and what they include, superannuation and any additional benefits). NOTE - be cautious of listing things like provisions of vehicles, accommodation in the contract itself as it may be difficult to amend or withdraw the provision down the track if needed - ask us how to navigate these!
• Leave Entitlements: Detail annual, personal and any other leave provisions.
• Confidentiality and Restraint Clauses: Protect sensitive business information and prevent conflicts of interest.
